PUBLIC OFFER AGREEMENT
FOR THE PROVISION OF TEMPORARY ACCOMMODATION SERVICES
The individual entrepreneur Chmyr Yelyzaveta Yuriivna, taxpayer registration number and other mandatory payments: 3546103708, hereinafter referred to as “Executor”, offers to an unlimited number of persons to enter into an agreement on the provision of temporary accommodation services on the terms set in this public offer, in accordance with Art. 641 of the Civil Code of Ukraine.
The Agreement is a public offer addressed to individuals and legal entities (hereinafter referred to as the “Customer”) and is valid until the parties fully fulfill their obligations.
1. General provisions
1.1. This document is a public proposal (offer) of the Executor to conclude an agreement for the provision of services for temporary accommodation in the premises of the barasport city apartments apart-hotel.
1.2. Acceptance of this offer is tantamount to concluding a contract on the terms set forth in this document.
1.3. Booking and/or payment of the Executor’s services via the barasport.ua website or in another way is considered acceptance of the offer.
2. Subject of the Agreement
2.1. The Executor undertakes to provide the Customer with services for temporary accommodation in the apart-hotel barasport city apartments, located at the address: Kyiv, st. Yevhena Konovaltsia, 36e, office 110/1, and the Customer undertakes to pay for these services in accordance with the tariffs published on the Executor’s website.
3. Procedure for providing services
3.1. Services are provided in accordance with the quality standards established by the Executor and the current legislation of Ukraine.
3.2. The Executor provides services during the period specified by the Customer during the reservation, and only after full prepayment.
3.3. The services are considered to be provided after the end of the period of stay specified in the reservation.
4. Rights and obligations of the parties
4.1. Rights and obligations of the Executor:
4.1.1. The Executor has the right to:
• Require the Customer to comply with the rules of residence and fire safety.
• Refuse to provide services if the Customer violates the terms of this agreement or the rules of residence.
4.1.2. The Executor undertakes:
• Provide services in a timely manner and in accordance with the terms of this agreement.
• Provide the Customer with all necessary information regarding the services offered.
4.2. Rights and obligations of the Customer:
4.2.1. The Customer has the right to:
• Use all services provided by the Executor in accordance with the agreement.
• Receive information about the rules of residence, use of apartments and services.
4.2.2. The Customer undertakes:
• Timely pay the cost of services in accordance with the terms of this agreement.
• Observe the rules of residence, safety and use of the Executor’s property.
5. Cost of services and payment procedure
5.1. The cost of services is determined according to the tariffs posted on the official website of the Executor: barasport.ua.
5.2. Payment for services is made by cashless transfer or by other methods specified on the website.
5.3. The price of services includes taxes and fees provided for by the current legislation of Ukraine.
6. Terms of cancellation of reservation and refund
6.1. The customer has the right to cancel the reservation under the following conditions:
• If reservation is canceled no later than 14 days before the date of arrival, 100% of the amount is returned.
• If reservation is canceled in 7-14 days before arrival, 50% is returned.
• In case of reservation cancellation less than 7 days before arrival, the funds will not be refunded.
6.2. In case of cancellation of the reservation on the initiative of the Executor, 100% of the paid amount is returned.
6.3. Refunds are made within 10 working days after receiving the relevant application from the Customer.
7. Liability of the parties
7.1. The Executor is responsible for the quality of the services provided in accordance with the current legislation of Ukraine.
7.2. The Customer is responsible for observing the rules of residence and use of the Executor’s property.
8. Force majeure
8.1. The parties are released from responsibility for non-fulfillment of obligations under this agreement in the event of force majeure.
9. Term of validity of the agreement
9.1. This agreement enters into force from the moment of acceptance by the Customer and is valid until the parties fully fulfill their obligations.
10. Final provisions
10.1. The Executor has the right to make changes to this agreement by posting information about the changes on his website.
10.2. All disputes arising from this agreement shall be resolved through negotiations, and in the case of failure to reach an agreement – in court proceedings in accordance with the legislation of Ukraine.
